— acquisition of land in Germany as required for the project,

— the defence of the appeal of the administrative plan approval decision at the Federal Administrative Court in Germany,

— the preparation and execution of the construction phase for the Fehmarnbelt tunnel within the framework set by the plan approval decision,

— support in general environmental matters, including acquisition and management of eco-accounts,

— preparation, negotiation and conclusion of railway crossing agreements, pipeline licensing agreements and intersection and utilities contracts.

The contract is tendered as one single agreement in order to achieve economics of scale, reduced costs for administration of the contract and a better understanding of the scope of services. Dividing the contract into lots is not considered to lead to a higher level of competition.

— at least one reference covering services related to German plan approval processes performed for a large infrastructure project with a total value (construction budget and various other expenses, including consultancy services) of at least 100 000 000 EUR excl. VAT,

— at least one reference covering land acquisition services performed in Germany for one project on which the tenderer has had a turnover of 100 000 EUR excl. VAT or more,

— at least one reference covering consultancy services related to the Natura 2000-network,

— that the appointed consultant is able to communicate with Femern A/S in writing and orally in German as well as English on a professional level.

Pursuant to Danish Act on The Complaints Board for Public Procurement (Act No 492 of 12.5.2010 with subsequent amendments — available at www.retsinformation.dk) § 7, the following time limits for filing a complaint apply:

1) 45 calendar days after the Contracting Authority has published a Contract Award Notice in the Official Journal of the European Union (with effect from the day following the publication date);

3) 6 months after the Contracting Authority has entered into a Framework Agreement (with effect from the day following the day on which the tenderers have been informed about the result of the tender).

The complainant must inform the Contracting Authority of the complaint in writing at the latest simultaneously with the lodge of the complaint to The Complaints Board for Public Procurement. The complainant must also state whether it is requested that the appeal is granted delaying effect, cf. § 12(1) of the said Act.
